FAQs
Is the analysis admissible in court?
While the analysis provided by our software is not directly admissible in court, it serves as a powerful tool for attorneys during depositions. By offering deep insights into witness candor, our technology aids legal professionals in crafting more effective questioning strategies. This can lead to the elicitation of testimony and the uncovering of facts that are admissible in court. Essentially, our software enhances the efficiency and effectiveness of the deposition process, enabling attorneys to navigate testimonies with greater precision and ultimately gather evidence that can play a crucial role in the courtroom.
Can the analysis be performed in real-time?
Currently, our software operates on a post-deposition analysis model, meticulously assessing recorded testimonies to provide insights into witness candor. However, we are excited to announce that our team is actively developing a live analysis feature. This upcoming enhancement will seamlessly integrate with video chat platforms, allowing for real-time evaluation during depositions. This innovation will enable attorneys to adjust their questioning strategies on the fly, further empowering them to uncover critical information and assess witness reliability as the testimony unfolds.
Is the readout provided an official transcript?
The output generated by our technology is not a certified transcript of the deposition. For all official and legal purposes, a certified court reporter must be enlisted to produce an official transcript. Our software's analysis enhances the deposition process by offering additional insights and perspectives, but it does not replace the essential role and legal standing of certified transcripts created by professional court reporters.
Is the consent of the deponent required?
In legal proceedings, the primary objective of the finder of fact, whether it be a judge or jury, is to ascertain the credibility of witnesses. As such, the process of deposing witnesses often includes videotaping to ensure a comprehensive assessment of testimony. Therefore, except under highly exceptional circumstances, deponents do not have the option to refuse videotaping during their deposition. This practice is standard in the legal field to maintain the integrity of the deposition process and facilitate a thorough evaluation of witness credibility.
Is there a need to establish a baseline for a deponent prior to conducting the analysis?
Unlike polygraph tests, which require establishing a baseline to gauge truthfulness, our software does not require any baseline measurement or prior information about the deponent to conduct its analysis. This innovative technology is designed to analyze witness testimony based on verbal and non-verbal cues within the context of the deposition itself, without the need for comparative data. This means our analysis can be applied universally, offering objective insights into witness candor and reliability from the moment the deposition begins.
